General conditions of sale

1. Acceptance of Terms 
These Terms of Use and Privacy Policy of Ripple (hereinafter “we”, “us”, “our”, “the company”) set forth the terms and conditions under which you, the user, may access and use the Ripple website (“Ripple”, “Ripple.tcc.com”, “Ripple TCC”). By accessing and using the website, you agree to be bound by our Terms of Use and Privacy Policy. If you do not agree with any of the Terms of Use or our Privacy Policy, you should not access or use Ripple (Ripple TCC). Even if you agree to the foregoing, we reserve the right to terminate or restrict your access to Ripple if you violate the Terms of Use or our Privacy Policy, or for any other reason, in our sole discretion. We also reserve the right to modify these Terms of Use from time to time. We will notify you of any such changes in writing.

2. About our products
2.1 We offer designer glass accessories for sale. The prices
of these products are shown on Ripple. We reserve the right to change the prices of these Products at any time.

2.2 The products offered by Ripple are handcrafted, which gives each item a unique character. Slight variations in color, texture, dimensions or finish may therefore appear from one product to another or compared to the photographs presented on the site. These differences, inherent to the handcrafted nature of the production, are considered a normal characteristic of the products and will in no case be considered manufacturing defects. They do not affect the quality or integrity of the products delivered.

3. Product warranty
Ripple guarantees its products against breakage during transport, and undertakes to replace them within a maximum of one year from the date of initial purchase. This warranty does not cover damage resulting from careless or incorrect use of the products. The defective product will be replaced by an identical product, while stocks last. If the product is no longer available, a credit note corresponding to the value of the product will be offered for the purchase of an alternative product.

4 Returns and Complaints
4.1 All product returns must be preceded by a written request to Ripple, specifying the reason for the return and details of the order. Ripple will examine the request and reserves the right to accept or refuse the return in accordance with the conditions stipulated in these GTC. In the event that the return is accepted, Ripple will provide the Customer with the necessary instructions for returning the product. Return costs may be charged to the Customer, except in the case of defective products or products that do not conform to the order. Returned products must be in their original, unused condition and in their original packaging to be eligible for a refund or exchange.

4.2 To benefit from the warranty during transport, the Customer must send a photo of the damaged product upon receipt of the package, including the packaging box and the filter. This claim must be made within 72 hours after receipt of the package. Replacement requests and any questions relating to the warranty must be sent to: ripple.tcc@gmail.com.

4.3 In accordance with current legislation, the Customer has a right of withdrawal of 14 days from receipt of the products to return any item, without having to provide a reason. If the Customer wishes to exercise this right of withdrawal, he must contact Ripple in writing to notify his decision to return the product. The product must be returned in its original condition, unused, undamaged, and in its original packaging. The return costs are the responsibility of the Customer. Once the product has been returned and checked, Ripple will reimburse the Customer within 14 days from receipt of the items, using the same payment method used for the purchase.

5. Price
5.1 Price of products
The prices of the products offered by Ripple are displayed in euros and include all applicable taxes (TTC), including the value added tax (VAT) in effect on the day of the order, unless explicitly stated otherwise. These prices do not include any possible delivery, packaging or other additional service costs, which will be indicated separately when validating the order and before the final confirmation of the order by the Customer.

5.2 Ripple reserves the right to modify its prices at any time, but undertakes to invoice the products on the basis of the rates in effect at the time the order is registered, subject to product availability.

6. Terms of payment
6.1 Terms of payment
Payment for products is made exclusively online, using the secure payment methods offered by Ripple when the order is validated. Available payment methods include, but are not limited to, credit cards (Visa, MasterCard, etc.), online payment services such as PayPal, or any other means specified on the site. All orders will be considered validated only after confirmation of full payment of the amount due. In the event of refusal of payment by banking institutions, the order will be automatically cancelled, without Ripple being held liable in any way whatsoever.

6.2 Non-payment and disputes
In the event of non-payment in full of the amount due by the agreed due date or in the presence of a dispute relating to an order, Ripple reserves the right to suspend the execution of the current order until the situation is regularized. In the event that payment is not received within a reasonable time or if the dispute persists, Ripple may also cancel the order without notice. The Customer will be informed of any suspension or cancellation electronically, without Ripple being held responsible for the consequences resulting from this suspension or cancellation.

7. Delivery
Products ordered are delivered to the address chosen by the Customer at the time of ordering. It is the Customer's responsibility to ensure that the information provided is correct and complete, including name, address and contact details. Delivery times are given as an indication only and may vary according to various factors, such as product availability, the delivery method chosen and logistical conditions. Ripple will make every effort to meet these deadlines, but cannot be held responsible for any delays, whether due to circumstances beyond its control or to unforeseen incidents.

8. Retention of title
Ripple retains full ownership of the products sold until full payment has been received, including any delivery costs, taxes and other applicable charges. In the event of total or partial non-payment, Ripple reserves the right, after prior notification, to demand the return of the products delivered at the Customer's expense and risk. This provision does not prevent the transfer of the risks of loss or deterioration of the products to the Customer upon delivery, the latter being responsible for the proper preservation of the items delivered. In the event of return of the products, any sums paid by the Customer may be retained by Ripple as compensation, without prejudice to any other actions it may take.

9. Force Majeure
Ripple shall not be liable for any delay or non-performance of its contractual obligations if such delay or non-performance results from force majeure. Force majeure means any external, unforeseeable, irresistible event beyond Ripple's control, such as, but not limited to: natural disasters, fires, floods, pandemics, strikes, interruptions or blockages of telecommunication networks, shortages of materials or energy, governmental or legislative decisions, or any other event making the normal performance of the contract impossible. In the event of force majeure, Ripple will inform the Customer as soon as possible and will endeavour to limit the consequences of the delay or non-performance. If the force majeure event continues beyond 30 days, either party may terminate the contract without compensation.

10. Applicable law and jurisdiction
These General Terms and Conditions of Sale (GTCS) are governed by French law. In the event of a dispute relating to the interpretation or execution of these GCS, the parties shall endeavor to resolve the dispute amicably. In the absence of an amicable agreement, any dispute will be submitted to the exclusive jurisdiction of the courts of the jurisdiction of Ripple's registered office, except in the event of a mandatory legal provision to the contrary, in particular with regard to consumer protection, which may confer jurisdiction on another court.

11. Miscellaneous
11.1 If any provision of these General Terms and Conditions of Sale (GTCS) is found by a court of competent jurisdiction to be void, invalid or unenforceable, the validity and enforceability of the remaining provisions shall not be affected thereby. The parties hereby undertake to negotiate in good faith to replace the clause concerned by a valid stipulation reflecting as far as possible the original intention.

11.2 The fact that Ripple does not assert, at any given time, any of the provisions of these T&Cs shall not be interpreted as a waiver of its rights subsequently under this provision or any other clause.
